This is how closely you need to pay attention to mobile no-parking signs.
Motorists must be especially careful when parking to check if mobile no parking and no stopping signs have been put up. This also applies in darkness, poorly visible sections, and when a short walk may be necessary.
Even those who claim not to have seen the signs must still pay the towing costs. This is demonstrated by a decision (Case No.: 14 K 222/23) of the Düsseldorf Administrative Court, as noted by the ADAC.
The case in question involved a man's towed car. He had parked it on the roadside one evening in October at around 9:30 PM. There was also a construction site in that area. The next afternoon, he returned to the spot, but his car had been towed.
Signs for mobile no-parking zone were up for weeks
When retrieving the vehicle from the impound lot, he had to pay 148 euros. He was informed that he had parked his car in an area with a mobile no-parking zone. The corresponding signs had already been there since August.
However, the man contested the towing costs. His arguments: He had not seen the signs because they were set up parallel to the road. Moreover, he could not oversee the sidewalk as other tall vehicles had obstructed the view. The matter went to court.
How does the court assess the local circumstances?
The illegal parker was not successful there. The court deemed the towing to be lawful. Parking in the construction site area posed a threat to public safety and order. Safe construction work is only possible if no vehicle blocks the access route.
Important: According to reports, as a driver, you must always pay attention to any signs indicating parking and stopping bans when leaving your vehicle. This applies even if it is dark and visibility is obstructed. Additionally, according to the court, it is reasonable to walk 15 meters up and down the sidewalk to search for such signs.
The fact that the signs were somewhat tilted in this case also had no impact on the judgment. This is because, in stationary traffic, the requirements for the visibility of signs are not as high as in moving traffic.
