Uber presents a study against minimum fares for rental cars – TMV Managing Director Meinhardt speaks of a hypocritical and questionable action
The American platform operator presents a survey suggesting that minimum prices in the rental car traffic could lead to nearly 30 percent of Berliners relying more again on their private vehicles. According to Uber, the minimum price is counterproductive in terms of traffic policy, as it would result in more private vehicles being on Berlin's roads again.
Leipzig Ruling Provides Legal Certainty
Since 2021, the Berlin Senate has been considering the introduction of minimum fares for rental car traffic. This possibility is opened by the revised §51a of the Passenger Transportation Act (PBefG). However, the legal implementation is considered complex. So far, binding minimum prices exist only in the city of Lörrach, while a similar attempt in Leipzig encountered legal hurdles. A decision by the Leipzig Administrative Court from last year confirmed, however, that minimum prices are generally permissible if public interests justify it.
According to taxi associations, minimum tariffs are an absolutely necessary tool against price dumping and unfair competition from rental car providers. However, these argue that their more efficient operational structures allow for more customer-friendly rates and that regulation would restrict access to affordable mobility offerings.
Uber warns of negative consequences
In the debate, Uber takes a clear stance against minimum tariffs. According to Oliver Fritz, a spokesperson for the company, higher prices in the rental car sector could reduce the attractiveness of mobility apps, thus bringing private cars back into focus. This would contradict the goals of a sustainable transport transition.
A survey commissioned by Uber is said to underscore this claim: More than half of the respondents (51.2 percent) stated that mobility apps facilitate access to public transport and improve their daily lives. The introduction of minimum tariffs could endanger this offering, according to Uber. Christoph Weigler, the company's DACH head, called for modern and innovation-friendly regulations instead of new restrictions on Tuesday.
Taxi and Rental Car Association (TMV) sharply criticizes Uber
Regarding Uber's attempt to prevent statutory minimum fares for taxis and rental cars in Berlin, Patrick Meinhardt, CEO of the Taxi and Rental Car Association Germany (TMV), states:
"With the clumsy attempt to prevent the overdue introduction of fair minimum fares in the Berlin mobility market at the last minute through a massive media campaign, Uber is scoring an own goal. Because in doing so, the company itself has proven that its business model is based on dumping prices for passengers and low wages for drivers. Additionally, Uber justifies its hypocritical warning about higher fares in Berlin with the results of a survey that it commissioned itself. For us as TMV, this questionable action once again serves as motivation to persist in our fight for fair competition conditions in the German taxi and rental car market as a whole.”
Decline in rental cars and taxis
The discussion is taking place against the backdrop of a continuous decline in the number of rental cars in Berlin. According to figures from the State Office for Citizen and Regulatory Affairs, the number of rental car permits decreased from 4,410 to 2,919 within a year. The number of taxi companies and permits is also declining, though less dramatically. The main reason for the drastic decline, especially in the rental car sector, is considered to be stre.
Uber to launch new service for Berlin outskirts
Meanwhile, Uber announced plans to start new projects to improve mobility in the outskirts of Berlin. Building on the experiences of the "last mile" service, further options are to be developed to strengthen connections to public transportation. The company plans to announce details in the coming weeks.
