BVTM takes stock of four years of PBefG amendment: Lots of law, little implementation

It was supposed to be a milestone – but it has mainly become an omission. Four years after the amendment of the Passenger Transport Act (PBefG) came into force, the Federal Association of Taxi and Rental Cars (BVTM) expresses disappointment.

In an online meeting introducing the new learning app "TaxiTrainer," President Herwig Kollar summed up the situation with one word: "Disillusioning!"

The goals of the law in 2021 certainly sounded ambitious: A clear demarcation between taxi and rental car operations, fair competition conditions, and a quality offensive through better training of driving personnel. The legislator had recognized that the emergence of platform services like Uber and Bolt was increasingly putting the traditional taxi industry under pressure—both legally and economically.

What stands on paper—and what is missing in practice

The law contains new instruments that could certainly have an effect: the possibility to set minimum transport fees for rental cars, reduced permits, a revised professional qualification. But: Very little was implemented.

"We now have to soberly realize that the administration does not follow the legislator," says Kollar.

In particular, the so-called "Basic Expertise," which is intended to serve as proof of basic knowledge in driving services, has not yet been introduced as binding in any municipality nationwide.

"This is a scandal," Kollar continued.

The lack is not in legal basis, but simply in political will.

Minimum Prices? No Trace

Many cities have so far shown restraint in introducing minimum prices for rental cars.

"We see this not only in the driver's license, we see it in almost all other areas as well. The only thing that has been implemented so far is the fixed price in taxis and thus the flexibilization of the taxi tariff," said the president.

Otherwise, all other instruments in the amendment are not being considered by the municipalities. There is also such a hesitant attitude towards minimum transportation charges for rental cars that one could already speak of refusal. Vice President Hermann Waldner also emphasized the association's position: MCRs are a means for fair competition, platforms cannot afford to violate them. Legally it is not possible, but also in public they would cast a bad light if they ignored the legal regulations. Waldner:

"We believe that minimum transportation charges for rental cars are the only instrument for maintaining the taxi trade."

Fixed prices, on the other hand, are used more frequently. According to Waldner, this instrument is also needed in competition to retain customers. Binding fixed prices are particularly familiar to younger customers, and they want that. "In Berlin, the prior payment of the fare in the app will be introduced on August 4th, the technical prerequisites have now been created for this."

An App Against Standstill

Instead of getting annoyed by the reform backlog, the association itself wants to contribute to quality assurance – and has introduced its own digital learning tool with "TaxiTrainer." Managing Director Michael Oppermann calls it "the best app for preparing for the upcoming exam." With 166 questions from the areas of traffic behavior, robbery safety, and inclusion, knowledge can be systematically refreshed. The best part: It is free – and can be conveniently used at the taxi stand.

The app also simulates the realistic exam: 16 questions in 60 minutes, at least twelve must be correct. With explanatory texts for each answer and an indication of whether the question is particularly relevant for taxis, rental cars, or collective demand transport.

The request of the federal association: Download the "TaxiTrainer" app and test it. And ideally, also leave a review. Because this is the same in all app stores – the number of reviews determines the ranking.

The association makes it clear: Quality in passenger transport is non-negotiable. The hope for the voluntary implementation of legal requirements is considered illusory.

“Unfortunately, legal compulsion is simply needed," is the tenor. Because: "We don't just drive cars – we drive people."

A statement that contains more truth than some decision-makers might be aware of.
